DEEPMOTION, INC. (“DEEPMOTION”, “We”, “Us” and “Our”) is committed to protecting and respecting your privacy. This privacy policy (“Privacy Policy”) sets out the basis on which any personal data We collect from you, or that you provide to Us, will be processed by Us. Please read the following carefully to understand Our views and practices regarding your personal data and how We will treat it.

This Privacy Policy applies to DEEPMOTION’s online AI motion capture and animation tools and platform, including DEEPMOTION’S Animate 3D web service, SDKs, DEEPMOTION’s APIs and other applications developed and published by DEEPMOTION or its customers and partners (collectively, the “Services”), through deepmotion.com and other DEEPMOTION websites and other interactions (e.g., customer service inquiries, user conferences, etc.) our users may have with DEEPMOTION. If our users do not agree with the terms, do not access or use the Services, websites or any other aspect of DEEPMOTION’s business.

Please also bear in mind that this Privacy Policy applies only if We collect personal data from you, i.e. if you use your selfie for creating the Avatar or give Us your email address (or provide Us any other personal data). If We do not collect your personal data, then We do not process your personal data and therefore this Privacy Policy does not apply.

In addition, our Terms of Use govern the delivery, access and use of the Services, including the processing of any videos, files or other content submitted through Services accounts (collectively, “Content Data”). The individual or organization that entered into the Terms of Use (each, an “Account Owner”) controls their instance of the Services and any associated user data Any individual, whether or not the Account Owner, accessing the Services through an account is referred to as a “User.” If a user is using an account in respect of which the user is not the Account Owner, the user should contact the Account Owner with any questions about specific account settings and privacy practices.

We have the right to unilaterally make amendments to this Privacy Policy. In such case the amended Privacy Policy shall be updated at this website.

Methods of Information Collection and Usage

DeepMotion collects data primarily for the purpose of improving our services and maintaining our products. We collect a few different types of data about our users:

Data that users provide to us:

We collect data provided by our users when they register for a DeepMotion Account, submit a contact us form, or sign up for our newsletters, such as full name, email, employer, and phone number. We may store messages sent to us through our web portals and sign up forms, and may collect information posted to our DeepMotion forums. We use this information in the development of products, to communicate with our users, and the operation of our services.

All users routinely submit Content Data to DEEPMOTION when using the Services. The processing by DEEPMOTION of Content Data including videos and 3D models users upload into DEEPMOTION’s Services constitutes a core element of DEEPMOTION’s Services.

When users interact with the Services, metadata is generated that provides additional context about the way users work. For example, DEEPMOTION logs the features, content and links users interact with, the types of files shared and what Third Party Services are used (if any).

We collect information about user engagement with our Services, including (but not limited to): (i) the date and time users uploaded videos to our Service; (ii) the frequency with which users process video uploads using the Service; and (iii) the frequency with which users download motion capture results.

We collect information about devices accessing the Services, including type of device, what operating system is used, device settings, application IDs, unique device identifiers and crash data.

Analytics:

We may directly collect analytics data, or use third-party analytics tools and services, to help us measure web traffic and user event trends. These tools collect information sent by your devices.

Cookies:

When visiting the DeepMotion website, we may send cookies to your device in order to identify your unique browser and expedite your login process. Cookies may also provide us with data used to improve our services and track your usage of our services. Persistent cookies (a cookie that persists on your hard drive whether or not your browser is still open) may be used by your browser in future visits to our site. Persistent cookies can be removed via the settings provided by your web browser. Conversely, a session cookie disappears after you close your browser. You can adjust your web browser settings to refuse cookies or track when we are sending a cookie to you. We use or may use cookies, log files, location data, and clear gifs information to: (a) remember information so that you will not have to re-enter it during your visit or the next time you visit the site; (b) provide custom, personalized content and information; (c) to provide and monitor the effectiveness of our Service; (d) monitor aggregate metrics such as total number of visitors, traffic, and demographic patterns; (e) diagnose or fix technology problems; (f) help you efficiently access your information after you sign in; (g) to provide advertising to your browser or device.

Who can see User Content:

Any User Content that you voluntarily disclose for posting to the Service remains private to you and DeepMotion and will not be shared publicly unless explicitly agreed upon by both DeepMotion and the user in question.

What happens in the event of a change of control:

We may buy or sell the company (including any shares in the company), or any combination of our products, services, assets and/or businesses. Your information such as customer names and email addresses, User Content and other user information related to the Service may be among the items sold or otherwise transferred in these types of transactions. We may also sell, assign or otherwise transfer such information in the course of corporate divestitures, mergers, acquisitions, bankruptcies, dissolutions, reorganizations, liquidations, similar transactions or proceedings involving all or a portion of the company.

Instances where we are required to share your information:

DeepMotion will disclose your information where required to do so by law or subpoena or if we reasonably believe that such action is necessary to (a) comply with the law and the reasonable requests of law enforcement; (b) to enforce our Terms of Use or to protect the security, quality or integrity of our Service; and/or (c) to exercise or protect the rights, property, or personal safety of DeepMotion, our Users, or others.

Sharing certain service type information we collect about you:

We may aggregate certain service type information, including information obtained through tools such as cookies, log files, device identifiers, location data and clear gifs (such as anonymous usage data, referring/exit pages and URLs, platform types, number of clicks, etc.) and strip data of all personally identifying characteristics in order to share that aggregated, anonymized data with third parties.

Third Party Service Providers and Partners:

To enhance your user experience or help us improve and measure our effectiveness, DeepMotion may embed code from third parties on the Service. We may engage third party companies or individuals as service providers or business partners to process service data and support our business. These third parties may, for example, provide virtual computing and storage services.

DEEPMOTION may use the following Subprocessors to host user data or provide other infrastructure that helps with delivery of our Services:

DEEPMOTION may use the following Subprocessors to perform other service functions:

  • SendGrid: marketing automation platform and email marketing service, United States
  • OKTA: user authentication and identification service, United States
  • Citrix Podio: project data and customer relationship management, United States and Denmark

The DeepMotion Privacy Policy does not apply to, and we cannot control the activities of third-parties. Please consult the respective privacy policies of such third parties or contact such third parties for more information.

How We Store and Protect Your Information

Storage and Processing:

Your information collected through our Services may be stored and processed in the United States or any other country in which DeepMotion or its subsidiaries, affiliates, or service providers maintain facilities. DeepMotion may transfer information that we collect about you, including personal information, to affiliated entities, or to other third parties across borders and from your country or jurisdiction to other countries or jurisdictions around the world. If you are located in the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that we may transfer information, including personal information, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction, and you consent to the transfer of information to the U.S. or any other country in which DeepMotion or its parent, subsidiaries, affiliates, or service providers maintain facilities and the use and disclosure of information about you as described in this Privacy Policy.

Keeping your information safe:

DeepMotion cares about the security of your information, and uses commercially reasonable safeguards to preserve the integrity and security of all information collected through our site and Services. To protect your privacy and security, we take reasonable steps (such as requesting a unique password) to verify your identity as a step in our account login process. You are responsible for maintaining the secrecy of your unique password and account information, and for controlling access to your email communications from DeepMotion, at all times. However, DeepMotion cannot ensure or warrant the security of any information you transmit to DeepMotion or guarantee that information on the Service may not be accessed, disclosed, altered, or destroyed. DeepMotion is not responsible for the functionality or security measures of any third party.

Compromise of information:

In the event that any information under our control is compromised as a result of a breach of security, DeepMotion will take reasonable steps to investigate the situation, notify individuals whose information may have been compromised and take other steps, in accordance with any applicable laws and regulations.

Your Choices about Your Information:

You control your account information and settings: You may update your account information and email-communication preferences at any time by logging in to your account and changing your profile settings.

How long we keep your private profile information:

Following termination of your User account, DeepMotion may retain your private profile information for a commercially reasonable time for backup, archival, or audit purposes. Any information that you choose to make public on the service may not be removable.

Children's Privacy

DeepMotion does not knowingly collect or solicit any information from anyone under the age of 13 or knowingly allow such persons to register as Users. The Service and its content are not directed at children under the age of 13. In the event that we learn that we have collected personal information from a child under age 13 without verification of parental consent, we will delete that information as quickly as possible.
